By accessing or using Hospitality Shield, you agree to these Terms of Service and any applicable subscription, service, order or enterprise agreement entered into with Hospitality Shield Group Pty Ltd.
Hospitality Shield provides digital hospitality compliance, food-safety support, audit, risk-management, records-management, communication and related software and operational support services.
Hospitality Compliance Support Officer (HCSO).Where included in a customer’s service package, Hospitality Shield may provide access to an HCSO. An HCSO is a Hospitality Shield representative who supports venues with food-safety monitoring, compliance records, staff guidance and operational readiness.
An HCSO does not replace an authorised government officer or the venue’s formally appointed Food Safety Supervisor. The venue remains responsible for appointing and maintaining any certified Food Safety Supervisor required by applicable food law and for meeting its own regulatory obligations. Hospitality Shield and its HCSOs do not exercise statutory inspection, enforcement or regulatory powers unless separately and lawfully authorised by the relevant government authority.
Users are responsible for maintaining the confidentiality and security of their account credentials, restricting unauthorised access, and ensuring information supplied to Hospitality Shield is accurate and kept reasonably current.
Users must not misuse the platform, attempt unauthorised access, interfere with security or service availability, upload malicious code, unlawfully access another user’s information, or use Hospitality Shield in a way that infringes another person’s rights or applicable law.
All Hospitality Shield software, branding, content, workflows, platform architecture, documentation and intellectual property remain the property of Hospitality Shield Group Pty Ltd or its licensors unless otherwise agreed in writing. No ownership rights are transferred merely by accessing or subscribing to the Services.
Customers retain their rights in business data supplied to Hospitality Shield. The customer grants Hospitality Shield the rights reasonably necessary to host, process, secure, back up, transmit and otherwise handle that data for the purpose of providing, maintaining, securing and improving the contracted Services, subject to applicable law and the Hospitality Shield Privacy Policy.
Subscription fees, implementation charges, HCSO service charges (where applicable), payment timing, GST and other commercial terms are governed by the applicable service agreement, subscription plan, proposal or order accepted by the customer.
Hospitality Shield will use reasonable efforts to maintain service availability but does not guarantee uninterrupted or error-free operation. Maintenance, internet failures, third-party services, security events and circumstances outside Hospitality Shield’s reasonable control may affect availability.
Hospitality Shield is designed to support compliance management and operational readiness. It does not guarantee that a venue is legally compliant, will pass an inspection, avoid enforcement action or satisfy every regulatory requirement applicable to its particular operations.
The customer remains responsible for its food business, staff, food handling, required appointments, certificates, licences, registrations, records and compliance with applicable laws and regulatory directions.
Any HCSO service is a private Hospitality Shield support service. An HCSO is not represented as an authorised government officer and does not replace the venue’s formally appointed Food Safety Supervisor.
To the maximum extent permitted by law, Hospitality Shield’s liability is subject to any limitations contained in the applicable written agreement and to rights and remedies that cannot lawfully be excluded or limited under Australian law.
Use of the platform is also governed by the Hospitality Shield Privacy Policy. Users and customers must handle personal information accessed through Hospitality Shield in accordance with applicable privacy laws and their own legal obligations.
Hospitality Shield may suspend or terminate access where reasonably necessary because of a material breach of these Terms, non-payment, unlawful conduct, misuse, cybersecurity risk, threats to other users or systems, or as otherwise permitted by an applicable service agreement or law.
Hospitality Shield may update the Services and these Terms from time to time. Where a change materially affects an existing customer’s contractual rights or obligations, Hospitality Shield will provide notice as required by the applicable agreement or law.
These Terms are governed by the laws of Western Australia and applicable Commonwealth laws of Australia. Subject to any mandatory rights or dispute procedures that apply, the parties submit to the courts of Western Australia and courts entitled to hear appeals from them.
